MiniGenius AI Terms of Service

These Terms govern the relationship between Alessandro Malizia, Italian VAT number 03204070605, based in Rome, Italy, and the parent or guardian who creates a MiniGenius AI account. By using the service, you confirm that you have read and accepted these Terms and the Privacy Notice.

The service

MiniGenius AI is a text and voice educational digital service for families. It allows a child to interact with Momo, play structured games, and listen to curated stories through a profile configured by the parent. Features and availability may depend on the plan, language, device, and safety limits.

Eligibility and acceptance

An account may be created only by an adult who can enter into a contract and has authority to authorise the child's use. If you do not accept these Terms, do not activate or use the service. The child's use remains under the responsibility and supervision of the parent or guardian.

Parent account and child profiles

You must provide accurate information, keep email access secure, and notify us of unauthorised use. Child profiles do not have independent credentials. Use a nickname and do not enter a full name, address, school, photograph, telephone number, or other unnecessary information. You are responsible for configuring age, language, and limits.

Nature of the service and AI limitations

Momo is an AI-powered digital character, not a person. Answers may be incomplete, inaccurate, repetitive, or based on misunderstood speech. Safety controls reduce risk but do not guarantee that every item will be correct or appropriate. The service does not replace parents, teachers, doctors, psychologists, or other professionals.

Plans, trial, and renewal

A Free plan and paid plans with different limits are available. The price, billing period, features, any free trial, and first charge date are shown before purchase and prevail over general descriptions. Unless stated otherwise, a paid subscription automatically renews for the same period until cancelled.

Payments, plan changes, and cancellation

Stripe handles checkout, payment methods, invoices, and the customer portal. You authorise the recurring charges shown at checkout. Upgrades may take effect immediately with any adjustment shown; downgrades may be scheduled for the end of the current period. You can manage or cancel the subscription through the Stripe portal. Cancellation stops future renewals and, unless otherwise stated or required by law, paid access continues until the end of the paid period.

Withdrawal and refunds

If you act as a consumer, you retain all mandatory rights under applicable law, including a right of withdrawal where provided. To exercise it or request a refund, contact hello@minigenius.ai with the account email and order reference, without sending full card details. Any exception relating to immediate performance of digital services applies only where legal requirements are met and the information and declarations required by law have been provided and obtained.

Technical and usage limits

We may apply daily, profile, message, voice, concurrent-session, and request limits. Only one child session may be active in a browser or device at a time. Limits support the selected plan, prevent abuse, maintain reliability, and protect children. You must not circumvent them.

Responsible use

You must not use the service for unlawful, abusive, or dangerous activity; attempts to obtain prohibited content; collection of children's data; interference with security or infrastructure; unauthorised automation; resale; or infringement of third-party rights. Momo must not be used for emergencies or medical, psychological, legal, or financial advice. An adult must intervene where there is risk or distress.

Intellectual property

MiniGenius AI software, trademarks, characters, graphics, catalogues, curated texts, and materials belong to the controller or their respective licensors. We grant you a personal, limited, non-exclusive, non-transferable, revocable right to use the service for family and non-commercial purposes. Rights in third-party content remain with their respective owners.

Availability and service changes

We seek to keep the service available and safe but do not guarantee uninterrupted or error-free operation. We may maintain, fix, modify, or remove features and providers, particularly for safety, compliance, technical sustainability, or cost reasons. Where a change materially affects a paid plan, we will provide reasonable notice where possible.

Suspension and closure

We may restrict or suspend an account for breach of the Terms, risk to children or others, fraud, non-payment, technical abuse, or legal obligation. Where possible, we will inform the parent and allow the matter to be clarified. You may stop using the service, delete profiles, and request account closure; some data may remain where required by law or needed to establish or defend legal claims.

Liability

MiniGenius AI is a supporting educational tool and requires adult supervision. To the extent permitted by law, we are not liable for damage caused by use contrary to these Terms, reliance on unverified AI information, unavailability beyond our reasonable control, or third-party services. Nothing in these Terms limits liability that cannot lawfully be excluded, including intentional misconduct, gross negligence, personal injury, and mandatory consumer rights.

Governing law and disputes

These Terms are governed by Italian law. If you are a consumer resident in the European Union, the mandatory protections of your country and the consumer forum rules remain applicable. Before starting a dispute, please contact hello@minigenius.ai so that we can try to resolve the issue.

Updates to these terms

We may update these Terms when the service, law, or operational risks change. We will state the new date and give reasonable notice of material changes. Where required by law or where a change materially alters the contract, we will request renewed acceptance. Continued use after the effective date constitutes acceptance only to the extent permitted by law.
